Can anyone share what they had to go through with the buyback process at Nissan? I've read some threads on here and they mention getting refunds or paying usage fees. Don't really understand what that all is about. Btw, my car is leased. I have '13 3.5SL /w Tech, 15K miles and 19 payments left and the car has been in 2 collisions (not my fault...)
Just got off the phone with a rep and she asked if I would be happy if they bought the car back or replaced it. I am trying to get the persistent rattles, CVT shudders and airbag light issues fixed and am not having luck at the dealerships.
Did a search didn't find much detail other than a bunch of threads saying they had their cars bought back - was trying to understand why people were charged for things and for what... ill keep looking and will search that user...thx

Still not finding the details about what to expect during the buyback process, but I am fully convinced that I should stick to my guns on this and get my car repurchased.
I wrote a letter to Nissan Corporate, they contacted me and brought up trying further to get repairs completed but they also mentioned a possible buyback or replacement. I did not bring this up, so it came out of their mouth on a recorded call. Not saying "possible" means definitely just saying they brought it up so they would need to bring reasons not to do that.
I'll be civil for a while, but will not hesitate to get a lawyer if needed...
Good luck dealing with their consumer affairs dept. My radio has been messed up since I bought my car, airbag lights comes on & off at certain times. Had it in numerous times and started the buy back process. They have 10 business days to do it, and mine was denied. I had it in again for same issue so they opened my case back up, denied again. I asked the regional consumer affairs lady how they can deny it but the car still isn't fixed. She told me the next step is to have a regional tech fly in to meet with me. Well they took a month to get this scheduled and he is finally going to be here tomorrow. I have since contacted a lemon law layer because Nissan is dragging their feet. The lawyer sent them a letter and to my knowledge Nissan never even responded, so they sent another one today. It has been hell on my end as my car will be 6 months old at the end of Sept and still nothing fixes But I have faith the lawyer will get them moving, hopefully!
I am by no means an expert, so please do not take this to heart or as a sure fire way to win.
First, you need to look up the laws in your state for buying back the lemon. You have 19 payments left on your lease so I'm going to assume you have had the car over a year? Some states give you a year some give you more. But it also matters on your miles.
Second, how many times have you had the car in for service for the same problem which has not been corrected? Make sure your service records are well kept.
Third, if you meet these buy back requirements you must first send Nissan a certified letter asking them to buy back your vehicle. They should respond and more than likely refuse. They will then contact an expert and get his input. If nothing is found and the problem persists either contact a Lawyer, or the Better Business Bureau. I went with the BBB and my car was bought back nearly a month to the day after contacting them. They flew another expert in who found an issue with my CVT and fixed it. Because a problem was found Nissan was forced to take the car back and give me a check for the difference.
I do not know how this works for a lease but this is how mine worked. Not all of them will go the same way. But you must follow the order I listed or you will be refused and shoved aside especially if the situation ends up in court.
my state is within a year or 15,000 miles.....so if it's after the year i am SOL. Still having trans issues while being on my second trans. I won't hit 15K miles until after the year
I'm sure this is posted many places so i'll be brief. They'll offer to replace it, buy it back with a "reasonable usage fee" or offer you cash to keep it. You leased I believe so the latter likely won't be an option. I had 10K on the car and they wanted $.25 per mile reasonable use. That's $2,500 off the check they'd write. I doubt you'll get them to budge on that on your own. My lawyer called bs and capped the usage at $.10 per mile UP TO the mileage of the first warranty issue. So, I paid about $200 to drive the car for a year. Good deal. Repurchase is 100% refund of $ down, tax, tags, title, fees, interest etc less your usage fee. In my case they offered me 1. a VIN swap 2014 upgrade at no charge, basically keeping the same loan payment and schedule on the new car. 2. $7,000 to keep it as is and fix it. 3. Repurchase. No brainer for me.

Each state has different rules on the usage fee. In CA the usage fee is governed by a formula based on how many miles the vehicle had on it when the defect(s) was actually reported by the buyer. I wound up paying about $1200 for the usage after driving it 17k miles and 21 months.
I'm still waiting on response to my lawyer's first request its been just over a month since the first letter went out. They must be buried in similar requests. We're sending a second notice today.
I just finish the buyback process now. I am getting a check for $8,500 coming in the mail now but I choose to keep the car and use the money to pay it off as the only issue is a rough idle which the dealer semi fix it but not 100% but it doesn’t brother me now that am getting a check.
Not sure to keep the car as the problem is semi fixed but maybe it can lead to future issue or trade it for another was looking into the Camry as they are solid car and are selling for super cheap but are super ugly. So not sure yet.
Might wait for the end of the year sale to see what I can get.
With the settlement does that void out any remaining warranty or does it end up branding your title at all? I'm pretty set on getting out from under this mess but curious about the other options.
sirchris, how long did your process take? You have me wondering if taking a monetary settlement and then doing a trade in might be better than a buyback. Carmax offered me about 6 grand under what I paid tax/title etc. So with 8k it could be even more advantageous.
I would imagine Nissan would rather avoid taking the car back as that adds additional responsibility and expense to them.
According to my lawyer he told me if I choose to keep the car the title will not be affect and my warranty stay in tact. I just will not be able to file another law suit for any other issue, for example my transmission go out.
And the whole process took about a month.
I choose this option as I have allot of mile so this was the biggest bang for the buck. And my issues are minor just very annoying.
Taking the money and keeping the car doesn't impact or brand the title. If you're not going to keep the car you should have taken the buyback, you would make out better than trading it in. B crags, I'm shocked your lawyer hasn't filed suit yet. 30 days no response in the legal world is the limit.
Yeah they said they allow for 60 days total before filing suit. They'll make 2 more attempts in the next 3 weeks to get them to respond It seems like they'd rather not put in the time since everybody knows it's always a prelawsuit settlement. I can appreciate the desire to avoid filling but i'm not terribly patient either.
I'll give em some more time. They started a similar process with our Jeep a week after we started with Nissan. We already received an initial response from Chrysler corp so I don't doubt their abilities. We sure know how to pick lemons.
Knock on wood, but no leaks or problems w/our 13 Wrangler yet. You probably signed something or were sent documentation that once the lawyer acts on your behalf you're responsible for their fees if you settle w/o them or hire other representation...careful looking at another lawyer. I'd stick it out. I guess if you just bought the car perhaps taking the cash and trading in would work. In my case I got a 100% refund which included EVERY payment made for 13 months. Because of that my refund was over $14K and the cash and keep it offer was 6 or 7K. Had I taken the $ I'd have been upside down on the loan since I bought early and Nissan has bombed the price...the only way to compete in such a competetive market w/a POS product.
OK so trying this without a lawyer... Filed the letter and spoke to the case agent today. She took a lot of information from me and said it will take 10 days to get a response. She seemed hopeful that they will do something for me and said she'd call me back in a few days to give me an update on progress. I'm skeptical but I'll give her a chance... Already been inquiring with a legal firm but we'll see... I don't really care about getting significant money back. I'd be happy getting my lease terminated and my taxes and registration prorated back, maybe even a few payments back since the problems escalated over the summer.
On an odd note - I don't know if this was you guys case but I called the hotline playing dumb to try and see where my case was... they said it was escalated to some regional executive care... not sure what that means or if it's bullshit.
Been there, the consumer affairs rep always seems sympathetic. Here's your future. On the 10th day you'll get a call saying your request was rejected. You'll be informed that an engineer will be dispatched to the dealer to fix your car. They'll "get it set up" and call you with a date in one week. In a week you'll get a call with an appointment within, but pushing 30 days. When you go meet the guy he won't even know why he's there (though you were assured already he's your savior). He'll look at the car all day and call you to come get it telling you "parts are on order and should be here within 2 weeks". THe goal is to keep you in it as long as possible. Do yourself a favor and get a lawyer now. It's a slam dunk, don't play their game, play yours.
Yep, if I just hated a car and got rid of it I wouldn't have much to say either. But if I bought a car that ended up being a PoS from a company that can't make it right and tries to make the process as difficult as possible I'd probably be telling stories for years.
Exactly. Maybe when I stop getting pm'd for help, seeing threads like this, being quoted and questioned I'll go away. Until then I'm here to offer my input to those in need. Whether or not some want to admit it, nissan has major problems right now and is not standing behind their product at all. If I can help someone stuck in one or educate someone considering one I will. If I were full of it I'd have been banned a long time ago. Perhaps if people don't want to hear it they shouldn't hang out in the buyback threads.
OK, well, I got the call back on day 4....sorry, but we don't have anything to offer you at the moment in terms of buy-back. You "haven't been un-necessarily inconvenienced" and, since this is your first Nissan, you need to take it back to the dealership for repairs since it is still under warranty. WHAT???????? How many trips to the dealership is needed?? I've been there almost ten times! This is my SIXTH Nissan, THREE back to back, all three with issues that I traded them as a result. I refuse to back down on this one. Nav, radio, bluetooth, airbag...all with issues, reported within the first 2000 miles. I have less than 6000 on the car now. I tried it on my own, and only got frustrated. I've turned it over to the attorney to finish up. I promise, if I ever get out from under this mess, I will NEVER own another Nissan. EVER.
Yep right there with you, I just had the BBB inspection on mine a few weeks back so hopefully I hear something soon. I agree with back2back, this is my 5th Nissan and I currently own a new 2014 Pathfinder as well. I'm just mad that Nissan isn't standing up to their vehicles and keeps pushing this off.
BTW my radio, Bluetooth, airbag did this from the day I bought it, reported it right away, 3 days after ownership, had a consumer affairs case opened the first month I owned, back in May and my car just rolled 15k.
Those of you going through BBB, did you use lawyer or work through consumer affairs? I'm about 7 weeks into this since taking on legal counsel. So far I've only had a single unacceptable response from Nissan.
My state requires that I go through BBB before going to court.
I went at it without the assistance of a lawyer. It really is an informal kind of meeting where I had the chance to state my problems, repair attempts outcome and how I thin it affects value and safety. The arbitrator was very in touch with the process. As expected, the nissan rep had an answer for everything. He was as prepared as I was. If you're articulate and able to outline and present a case on your own, I don't see the need for a lawyer. In KY, that would cost me out of pocket because they do not arbitrate lawyer fees, may be the same case in your state...
No BBB for me. I tried with Consumer Affairs, got denied quickly, and on the advice of Back2Back, called 1800LEMONLAW and hired an attorney. I have too much to do in life to run back and forth with Nissan and don't need the stress of it. I'm hoping to have the case reviewed in the next week or so.
Well, my request was denied by the BBB. According to the arbitrator, none of my complaints were exhibited in the 6 mile test drive we took (to be fair, they weren't) and he couldn't find reasonable loss of value or safety to the vehicle.
Although he saw pictures and video of the problems, since they weren't duplicated in our test drive, they must not exist. f-face.
According to the Nissan tsb's and the owners manual covering the calibration of the OCS, my car isn't a "one off" thus making it a lemon. Now I'm wondering if I even have a case in court if I choose to go that route.
