I'm boggled how the named defendants could be held responsible and I am curious to know the actual filed claim. Also how can you deem ANY bat Safe in little league? This Ain't whiffle ball or even nerf ball. Whats next? Rawlings, Spalding? Sue the ball company for making a hard ball.

We should all just play kickball.

man thats cause kids growing up these days are sissys u cant do this u cant do that u know shit kids should learn by the mistake in this kids case dont be on the field if u are not in the legue or if you dont want to get hurt. u know when u were young and your parents tell u not to play with fire and u get your a** burned well u learned not to play with fire or u are gonna get hurt let the kids be kids. i think the parents just want the medical bills paid. either way its stupid i want to now the outcome of the case

definitely ridiculous... to whoever said about the losers pay thing, i definitely think that the US desperately NEEDS something like this implemented. then you wouldn't see anything but legitimate court cases. or at the very least, very few retarded ones like this... sorry the kid got hurt, but srsly, who doesnt know that could happen in baseball... i mean, when i was a kid i played 3rd base. this one time i caught a nasty crack right down the line. i barely had enough time to react and the damn ball hit my left shoulder REAL HARD. hard enough to knock me the **** down. funny shit tho, the ball bounced off my body into my mit i was sore for a few weeks, and still have some minor shoulder aches and pains to this day that i can only really attribute to that injury. however, you dont see me suing everyone under the sun for my own damn ACCIDENT. people just dont understand that ACCIDENTS happen. sometimes, things are NOBODY's fault

Honestly, its terrible that this kid seems to have maybe suffered irreparable harm, but its stupid that the suit was ever filed. A decent lawyer should be able to get this thrown out by a quick review of the indemnicication document that the parents should have been required to sign, but its very possible that one or more of the defendants will cough up a settlement to make it go away. Sadly this is the state of the vast majority of the personal injury cases these days...companies with deep pockets find it far easier to toss a half million dollars at some idiot filing a frivolous lawsuit than it is to prove their innocence.

I kinda laughed when I first saw this article. I was curious to see some of the responses. I coach 7/8 kids. I play 3 games a week. I particularly laughed at the one reply of the bats fly off the bats because the are so light. Well, not that it matters because the balls of today are a soft core cork material. They are sponges so the kids don't get hurt. Carlin said it best, "The world is shit. It's made up of a whole lot of losers and a few winners" Parents are so concerned with safety that they forget the game. There's cages on the helmets. Soft balls and people are concerned about bats. Well, here's a thought, I have 9 boys on my team, do you think any of them wear a cup? No, the parents don't feel it's needed. You mean to tell me that if this kid got a line drive off the nuts as opposed to the chest and couldn't get it up the rest of his life, would they still sue? It's the parents fault for not the child properly equipped or trained to understand the ramifications of the situation.

Agreed 100%. I do not think that the argument between wood vs aluminum is a useless debate because it does have merit for the very reasons you mentioned. The bats are lighter and metal is more rigid which makes it more resistant to shock absorption therefore giving it a much faster speed off the bat. Add that to the fact that kids have a slower reaction time than adults and you have greater chances for a serious injury. I've always been one to favor wooden bats over aluminum bats. It's the way the game was intended.

As for this lawsuit, complete bullshit.

When I can walk into a sporting goods store, take out my Credit Card, Ask the employee to open up the bats in the locked case.....(Just like Guns) And drop 500.00 on a frickin bat.....Something is seriously fuccin wrong. In my day...the top of the line bat was about 70 bucks.....And that was crazy

The decision was overturned on appeal in McDonald's favor. I was happy McD's fought it instead of paying her...it cost them more in the long run, but at least it turned out right in the end.

Sadly the lesson we have to take from all this is that its only a matter of time before you lose everythingyou own to some kid's parent when he gets a line drive to the nuts...it will be all your fault because you didn't force the issue...of course if you force the issue you'll probably have to kick a few kids off the team for non compliance and then you'll get sued for discrimination or somethingt.
